PRIVACY POLICY

How do we collect your personal data

Your personal data will be collected and processed by BMcar in the following situations:

• If you contact us directly through our websites or BMcar's customer service, and if you are interested, for example, in our products and services and/or if you have other questions.

• If you buy Rolls-Royce products or services directly from our BMcar Porto Authorized Repairer.

• If you respond to one of our direct marketing campaigns, for example, by filling out a reply card or making your data available online on one of our websites.

• When you provide us with your vehicle data, including your vehicle identification number (whether made available via Rolls-Royce Motor-Cars Teleservices, Keyreader), within the scope of the service and maintenance/repair service process.

What personal data can be collected

• Contact details: Name, address, telephone number, e-mail address and Vat number

• Other personal data: Information that has been provided to us about your birthday, marital status, education, or professional situation.

• Vehicle configuration and feature details: Information regarding your vehicle's current features and configurations (identified based on your vehicle identification number), such as Teleservices from Rolls-Royce Motor Cars.

For what purposes and on what basis can your personal data be used

The data obtained in the context of the conclusion of the provision of a service are treated for the purposes identified below.

A. Compliance with contractual obligations in the field of vehicle maintenance and repair and product sales:

BMcar use your personal data for the purpose of administering the provision of services (for example, for the purposes of requests for quotations, order requests, repair workshop requests, scheduling of Services). With respect to all questions relating to the administration of the provision of services, including satisfaction surveys related to service follow-up, and/or responding to requests made, we will contact you regardless of any basis of autonomous legitimacy, for example by writing, telephone, messaging services, e-mail, depending on the type of contact you have specified (if applicable).

As part of the maintenance and repair processes or services carried out at BMcar, diagnostic and programming equipment is used, equipment that allows the key to be read on site or remotely, in the case of an appointment (via Remote Keyreader). These data are processed and used in the Repairer by qualified technicians in order to diagnose and repair any faults. The technical data relating to the vehicle essentially consists of:

• Main data of the vehicle (for example, identification number, type, date of manufacture, equipment)

• Vehicle condition data (measured values, for example the mileage)

• Error memory records

• Software versions

• Service and workshop data (service requirements, work performed, spare parts installed, equipment warranty cases, workshop reports).

Rolls-Royce Motor Cars can access this information in order to support Authorized Dealers and Repairers in technical matters, or other challenges, which they may face in the course of providing their services.

B. Customer Assistance

BMcar and Rolls-Royce Motor Cars use your personal data for the administration of the provision of services (for example for repair orders, service appointment) or for responding to requests you have made (for example, request proposal, doubts and complaints).

We will also contact you if your vehicle has been covered by a technical or recall campaign. We will contact you directly or indirectly through Rolls-Royce Motor Cars, using the contact details you have provided, to comply with our legal obligation.

BMcar also treats your data for this purpose to optimize your experience with Rolls-Royce Motor-Cars customer service, for example to identify you correctly whenever you contact us.

C. Promotional communications and market research

If you have given us your consent for the additional use of your data, it may be used in accordance with the scope described in the respective declaration of consent.

 For example, of consent for promotional purposes (offers of products and services), definition of individual customer profile and/or market research and, if necessary, their transmission to certain contractual partners.

You can withdraw your consent at any time, with effect for the future.

D. Compliance with legal obligations to which BMcar is subject

BMcar will also process personal data if you have a legal obligation to do so.

BMcar is subject to a variety of legal obligations. We may process your personal data as necessary to comply with these obligations, as well as transmit them to the authorities by notification. Additionally, we will treat your personal data to the extent necessary to manage legal actions.

How do we keep your personal data safe

We use a variety of security measures, including encryption and authentication tools, to help protect and maintain the security, integrity and availability of your personal data.

Although data transmission over the internet or website cannot guarantee complete security against intrusions, we and our service providers and business partners make the best efforts to implement and maintain physical, electronic and procedural security measures designed to protect their personal data in accordance with the applicable data protection requirements. Among others, we implemented the following:

• Restricted personal access to your personal data based on the “need to know” criterion and only within the scope of the communicated purposes;

• Transfer of collected data only in encrypted form;

• Storage of highly confidential data only in encrypted form;

• Protection of IT systems through firewalls, in order to prevent unauthorized access to your personal data;

• Permanent monitoring of access to information technology systems with a view to preventing, detecting and preventing the misuse of your personal data.

How long do we keep your personal data

We will store your data only for the period of time strictly necessary for the respective processing purposes. If the data are processed for different purposes, they will be automatically deleted or stored in a format that does not allow conclusions about your identity to be drawn, as soon as the last specific purpose is extinguished.

In order to comply with contractual obligations and assist the client within the scope of the same, the data provided by you may be kept for the term of the contract and 10 to 12 years after its termination, with a view to fulfilling legal obligations to file, such as the records and documents supporting tax-relevant transactions under tax law.

The data that in our opinion is necessary to evaluate and prevent complaints against us or to defend our rights and interests in lawsuits, brought by you or against you and/ or third parties, may be kept until the date when it is expected that the complaints and/ or lawsuits may commence or, if they have taken place, after the final decision has become final.

Use of promotional communication purposes and market research based on consent. Within the scope of the purposes in question, your data will be kept for a maximum period of 10 years counted from the collection of your consent or the last contact made (whichever occurs last) and if, within this period, you have not their consent withdrawn.

Your personal data can be accessed by our contractual partners, Rolls-Royce Motor Cars, for the purposes described in this Privacy Policy. Your personal data being treated according to appropriate security measures.

How you can change or withdraw your consent

You can, at any time, change or withdraw your consent, with effect for the future. After withdrawing your consent statements completely, you will no longer be contacted and receive communications for the purposes you have selected in the respective consent statement.
